Consumer distance contract
Distance sales agreement.
The framework contract for retail sales concluded through monelia.store. The customer's checkout summary and order email complete the product-specific terms.
Parties and subject
The seller is MG DEĞER GIDA ANONİM ŞİRKETİ; MERSİS 0620169058000001; Trade Registry 1114090; VKN 6201690580, Davutpaşa Vergi Dairesi; Maltepe Mah. Eski Çırpıcı Yolu Sk. Parima No: 8 İç Kapı No: 85, Zeytinburnu / İstanbul, Türkiye; store@monelia.com.tr; +90 212 665 05 05. The buyer is the person identified in checkout and the order record. This agreement governs the sale and delivery of the products identified by the order reference.
Integral records
The product page, cart, checkout summary, pre-information form, selected currency, delivery details, acceptance timestamp and order confirmation are integral parts of this agreement. If a mandatory rule conflicts with this text, the mandatory rule prevails.
Price and payment
The payable product total is the amount confirmed immediately before ordering. Charges not expressly included are handled as stated in the pre-information form. Card payments, once activated, are processed by the payment provider. MONÉLIA does not store complete card details. A quote request, saved order or proforma does not prove payment.
Contract formation and stock
For a priced retail order, the contract becomes effective following the buyer's electronic acceptance, successful payment authorization and MONÉLIA's order acceptance. If supply becomes impossible, MONÉLIA informs the buyer within the legal period and refunds amounts required by law. Obvious pricing or technical errors are handled without limiting mandatory consumer rights.
Delivery and transfer of risk
Products are delivered through a suitable carrier to the stated address. Risk passes in accordance with mandatory consumer law, normally when the buyer or a designated third party physically receives the goods. Delay caused by incomplete address, failed access or customs/customer action is handled according to the circumstances and law.
Withdrawal, returns and legal guarantees
The 14-day withdrawal procedure and statutory exceptions are described in the pre-information and returns policy. Rights relating to non-conforming, defective, damaged, unsafe or incorrect goods are independent of withdrawal and are not waived.
International consumer orders
International retail availability depends on destination, sanctions, food-import rules and carrier capability. Unless expressly included, the customer/importer pays customs duty, import tax, clearance, local storage and brokerage costs. MONÉLIA remains responsible for product conformity and the delivery obligations expressly accepted or imposed by mandatory law.
Business and wholesale orders
Purchases made for commercial or professional purposes may not qualify as consumer transactions. International wholesale and distributor orders are governed by the written quotation, proforma, bank-transfer conditions, agreed Incoterm and separate contract rather than this consumer agreement.
Personal data and communications
Order data is processed as described in the separate privacy notice. Transactional email, phone and carrier messages may be sent to perform the contract. Optional marketing requires a separate lawful choice.
Applicable law and disputes
Turkish law applies without depriving an overseas consumer of non-waivable protection in the consumer's habitual residence. Competent Consumer Arbitration Committees and Consumer Courts may be used under Turkish law; mandatory jurisdiction rules remain reserved.
